Work Restrictions for Student Visa Holders

We are delighted to share with you that The Department of Home Affairs (Immigration and Citizenship) has announced from 1 July 2023, work restrictions for student visa holders will be re-introduced and capped at the increased rate of 48 hours per fortnight.

Although this is not completely the increase in hours we were all hoping for, it still ensures that student visa holders are able to focus on obtaining a quality Australian education and qualification, while remaining able to support themselves financially, gain valuable work experience, and contribute to Australia’s workforce needs.

The following information is vital for management:

  • Plan your rosters well in advanced to accommodate the 48 hours per fortnight rule for all students.

  • Review your actual hours vs schedule on a weekly basis to make the necessary adjustments to the roster to accommodate and stay within the 48-hour per fortnight rule.

  • During holidays, ensure to obtain written proof from the college/university that your employee on a student visa can work more hours during this period.

We strongly recommend a visa audit to ensure that your employees on visa’s have a current valid visa with working rights. If a company is found to be in breach of an employee’s visa the organise can face a fine of $16,200 or more as well as other penalties.
